Trust Administration
A trust is a legal arrangement in which an individual (the grantor) gives fiduciary control of property to a person or institution (the trustee) for the benefit of beneficiaries. Trusts can provide protection of an individual’s assets during their lifetime or in the event of a disability, and can be structured to ensure the support and security of a decedent’s family, usually with significant tax savings. The Trust Department administers the assets according to the instructions in the written trust document.
Estate Administration & Guardianship
Estate Administration, or probate, is the process by which the estate (property) of a deceased person (decedent) is distributed to heirs at law in an intestate (without a will) death or to designated beneficiaries in a testate (with a will) death. The probate process is governed by the probate laws of the state in which the decedent maintained legal residence at the time of the death and/or by the probate laws of the state in which property was left at the time of death.
Certain individuals are not legally able to handle their own affairs because of age or incapacity. Upon a petition of an interested person, Courts may appoint an individual or financial institution as guardian or conservator to handle the affairs of a minor or an incapacitated individual. The Trust Department, as guardian of the estate, performs the following duties:
- Safeguard assets
- Inventory assets for review by the Court
- Manage and invest assets
- Pay ongoing debts and obligations
- Prepare and file state and federal tax returns
- Prepare and file annual and final financial accountings for review by the Court
- Consult with personal care providers
